経営管理ビザとは、外国人の方が日本で会社を設立し、その経営または管理に従事する場合に必要な在留資格です。その取得には、まず事業計画をたて、日本での場所を定め、会社を設立します。許認可などを得ましてから、経営・管理ビザの申請を行いビザが取得できます。

流れはこうなります。

日本に信頼できる知人やご親戚の方がいない方、または日本の銀行口座をお持ちでない場合は、経営・管理ビザの取得は難しくなります。

3,000万円以上の資本があり、日本語能力があり、学位または実務（3年）のある方が対象になります。本国にいながら、会社設立のための定款と事業計画をまず作成します。完成しましたら、この時点で、これらの書類を使い、在留資格認定証明書の申請を、本国から代理人や行政書士などを通じ申請します。認定証明書を使って４ヶ月経営管理ビザを取得し、来日します。4ヶ月以内に会社設立登記や資本金振込、事務所契約などを全て完了させます。この時点で、1年以上の経営管理ビザに更新します。

流れは以下の通りです。

1. 本国で定款案作成・事業計画書作成

2. 本国から在留資格認定証明書交付申請・本国で証明書受領

3. 本国の日本大使館でビザ発給

4. 来日して自分で会社設立手続き（4ヶ月以内）

   事務所契約、資本金振込、会社設立登記、税務署等届出、常勤職員雇用、専門家事業計画確認など

5. 在留期間更新許可申請

4-Month Business Manager Visa

This visa is available to those with capital of ¥30 million or more, Japanese language proficiency, and a degree or three years of practical experience. First, prepare the articles of incorporation and business plan for company establishment while in your home country. Once completed, use these documents to apply for a Certificate of Eligibility from your home country through an agent or administrative scrivener. Use the certificate to obtain a 4-month business manager visa and travel to Japan. Within four months, complete company establishment registration, capital transfer, office contract, etc. At this point, your business manager visa will be renewed for a period of one year or more.

The process is as follows:

Prepare the draft articles of incorporation and business plan in your home country.

Apply for and receive the Certificate of Eligibility from your home country.

Receive the visa at the Japanese embassy in your home country.

Arrive in Japan and complete the company establishment procedures yourself (within four months).

Contract office contract, capital transfer, company establishment registration, tax office notifications, hiring full-time staff, expert business plan review, etc.

Apply for residence period extension.

外国人個人事業主になるにはHow to become a foreign sole proprietor　　　　　　　　　

経営・管理ビザは大幅に厳格化され、個人事業主であっても、3,000万円以上の資本,常勤1名以上の雇用,日本語能力などが必要となりました。資本が少なくて個人事業主を希望される場合は、経営・管理ビザではなく次の２つの方法が考えられます。技人国ビザまたは身分系ビザです。学歴、職歴、専門性などが、技術・人文知識・国際業務ビザ ( ITエンジニア、プログラマー、通訳など）に該当される方で、複数の企業と委任契約、委託契約、嘱託契約などの契約を結び、安定した収入があることを証明できる場合に可能になります。また、永住者、日本人の配偶者等、永住者の配偶者等、定住者などの資格を得た方は、就労制限がありませんので、個人事業主として自由に活動できます。

If you have little capital and wish to become a sole proprietor, there are two options available instead of a Business Manager visa:

A Skilled Worker Visa or a Status-Based Visa.

This visa is available to individuals whose educational background, work history, and expertise qualify for a Technical/Humanities Specialist/International Services visa (IT engineer, programmer, interpreter, etc.), who have concluded contracts such as agency contracts, outsourcing contracts, and part-time contracts with multiple companies, and who can prove they have a stable income.

In addition, individuals with status such as permanent resident, spouse or child of a Japanese national, spouse or child of a permanent resident, or long-term resident are not subject to employment restrictions and can freely operate as a sole proprietor.

経営者として外国人の方が飲食店を経営するには、「経営・管理」の在留資格を取得します。

経営者自身が調理されることは多いですが、この在留資格で調理業務を行うことはできます。しかし内容によっては別途技能ビザが必要になることがあります。また、料理人、スタッフを雇用しなければならない場合もあります。
